Terms and Conditions

HG SAME DAY COURIER – TERMS AND CONDITIONS OF CARRIAGE

These Terms and Conditions (“Conditions”) govern the provision of courier and delivery services by HG Same Day Courier. By booking or using our services, you (“the Customer”) agree to be bound by these Conditions in their entirety. Please read them carefully.

1. DEFINITIONS

Carrier – HG Same Day Courier, its employees, agents, and subcontractors.
Customer – The person, firm, or company that contracts for the services of the Carrier.
Consignment – Any goods, parcels, packages, documents, or other items transported by the Carrier on behalf of the Customer.
Consignee – The person or entity to whom the Consignment is to be delivered.
Booking – The Customer’s request for the Carrier to provide services, whether made by telephone, email, or through the Carrier’s website.
Dangerous Goods – Goods classified as dangerous by IATA, ADR, or relevant regulations (explosives, radioactive materials, flammable substances, etc.).
Excluded Goods – Items for which the Carrier accepts no liability unless agreed otherwise in writing (see Clause 7).
Prohibited Goods – Items the Carrier will not carry under any circumstances (see Clause 7).

2. GENERAL

2.1 The Carrier is not a common carrier and may refuse any Booking or Consignment at its discretion.

2.2 These Conditions apply to all contracts for the carriage of goods between the Carrier and the Customer, overriding any terms the Customer may try to apply.

2.3 No variation or alteration of these Conditions shall be valid unless agreed in writing by a director or authorised officer of the Carrier.

3. BOOKINGS AND QUOTATIONS

3.1 The Carrier shall provide the Customer with a quotation for the services upon request.

3.2 All quotations are valid for seven (7) days unless stated otherwise.

3.3 A contract is formed when the Customer accepts the quotation. Bookings are subject to availability.

3.4 The Customer warrants that all information provided at the time of booking (nature of goods, collection address, delivery address, etc.) is accurate.

3.5 Waiting time may be charged after the initial 30 minutes free period.

4. CHARGES AND PAYMENT

4.1 All charges shall be based on the vehicle required, mileage, weight, dimensions, and the nature of the consignment.

4.2 Additional charges may be applied for waiting time, loading/unloading, detours, or variations from the original Booking.

4.3 Invoices are payable within thirty (30) days unless agreed otherwise.

4.4 Non-account customers must pay in full at the time of booking.

5. CUSTOMER OBLIGATIONS

5.1 The Customer warrants that all information provided is accurate, including the nature of the goods, collection address, and delivery address.

5.2 The Customer warrants that all consignments are securely and properly packaged.

5.3 The Customer warrants that all Consignments are legal, safe to transport, and do not contain Dangerous or Prohibited Goods.

6. PROHIBITED AND EXCLUDED GOODS

6.1 Prohibited Goods (not carried under any circumstance)

Firearms, explosives, illegal drugs, human remains, hazardous/dangerous goods, or any item prohibited by law.

7. DELIVERY

7.1 The Carrier will use all reasonable endeavours to complete delivery within estimated timeframes, but time is not of the essence.

7.2 A signature or proof of delivery is conclusive evidence that the Consignment was delivered complete and in good order.

7.3 If delivery cannot be completed, a card may be left and the Customer notified. Redelivery or return fees may apply.

8. LIABILITY AND INSURANCE

8.1 The Carrier’s liability for loss or damage is strictly limited. Customers should secure their own insurance for high-value consignments.

8.2 The Carrier’s liability is limited to £25,000 per consignment (reflecting the Carrier’s Goods in Transit insurance level).

8.3 The Carrier is not liable for consequential or economic loss, including loss of profit or market.

8.4 The Carrier is not liable for loss, damage, or delay caused by events beyond its control, including acts of God, war, terrorism, riots, strikes, extreme weather, traffic, or seizure by authorities (Force Majeure).

9. CLAIMS

9.1 Claims must be made in writing.

  • Damage/partial loss: within 7 days of delivery

  • Total loss/non-delivery: within 14 days of dispatch

9.2 Proof of value (e.g., supplier invoice) may be required.

10. CANCELLATION

10.1 A cancellation fee may apply if a vehicle has already been dispatched.
The fee will reflect distance travelled and costs incurred.

11. DATA PROTECTION

11.1 Personal data is processed in accordance with GDPR and the Carrier’s Privacy Policy.

12. GOVERNING LAW

12.1 These Conditions are governed by the laws of England and Wales.
Any disputes are subject to the exclusive jurisdiction of the English courts.
